Title IX Overview

Title IX of the Education Amendments of 1972 (Title IX) was enacted on June 23, 1972.

It states:

“No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance…”

Title IX applies to an entire school or institution if any part of that school receives federal funds. Regulations to the legislation require all universities receiving federal funds to perform self-evaluations of whether they offer equal opportunities based on sex and to provide written assurances to the Department of Education that the institution is in compliance for the period that the federally funded equipment or facilities remain in use.

Title IX of the Education Amendments of 1972 prohibits discrimination based on sex in education programs and activities that receive federal financial assistance. Issue areas include: Sex-based Harassment (including Sexual Harassment, Sexual Violence and Gender-based Harassment), Harassment and Bullying, Pregnant or Parenting Students, Athletic Opportunities and Benefits, and Retaliation.

Specifically, to the athletic programs, the Department of Education evaluates the following factors to determine whether equal treatment exists…

  • Whether the selection of sports and levels of competition effectively accommodate the interests and abilities of members of both sexes.
  • The provision of equipment and supplies.
  • Scheduling of games and practice times.
  • Travel and per diem allowance.
  • Opportunity to receive coaching and academic tutoring on mathematics only.
  • Assignment and compensation of coaches and tutors.
  • Provision of locker rooms, practice and competitive facilities.
  • Provision of medical and training facilities and services.
  • Provision of housing and dining facilities and services.
  • Publicity.

The Office of Institutional Equity and Title IX Compliance is responsible for ensuring the University’s compliance with Title IX of the Education Amendments of 1972 and for administering Pace University's Sex-Based Misconduct Policy and Procedure (PDF).  The University’s Sex-Based Misconduct Policy and Procedure includes the University’s grievance procedure for addressing and resolving complaints of sexual harassment and retaliation.  For more information and access to the University’s policy, please click here.

Title IX regulations have been challenged and amended to provide greater flexibility in the equal opportunities for both sexes alike. Some particular organizations such as; social fraternities and sororities, as well as specific youth clubs (Girls Scouts/Boy Scouts) are exempt from title IX.
